Can a Stepparent Seek Visitation After a Divorce?

The conditional answer is “Yes.” It is conditional because the result often depends on the relationship between the child or children and the biological parents as well as the relationship established with the stepparent.
Under Minnesota Statutes §257C.08, subd. 4 visitation rights may be allowed by a court for any person, other than a foster parent, who has lived with e child for two years or more,. The Court must find, however, that:
- Visitation rights would be in the best interest of the child;
- The petitioner and child had established emotional ties creating a parent and child relationship; AND
- Visitation rights would not interfere with the relationship between the custodial parent and the child.
The Court can consider the preference of the child if the child is deemed to be of suitable age and maturity to express a preference.
